They were listed with the 4th AL Regiment, 90 Day Men, also known as Byrd's Regiment [Col. William M. Byrd]. Some of this regiment later enlisted with the 38th or 40th AL Infantry Regiments. According to the caption history, Modawell's Company was stationed at Mobile between 9 April and 25 June 1862. According to the Inspector and Mustering Officer, Capt. John H. Gee, "this regiment is composed of "Ninety-Days" men, who have armed and equipped themselves, have been employed in the city of Mobile mainly as a police force, and have had but little opportunity for improvement in discipline instruction." (The same was said for most companies in the unit)
