My error, he signs as Capt. Co. E, 33rd Alabama, His script looks like a 55.

An endorsement on his resignation request, states he had been absent sick since May 9. And on only the one card regarding his resignation, resignation request is dated December 30, it states: "Date of Resignation February 9, 1863"
