Gilbert's resignation was accepted on Oct. 14, 1863, John C. Hutto being promoted to take his place.

Companies mentioned by Major Gilbert could have been those identified as belonging to Foster's Alabama Battalion. This command had partially organized under Colonel Roddey’s direction in Lauderdale County during September of 1863. Most officers and men were captured near Wayland Springs, Ala., Oct. 31, 1863. Many reported themselves to Federal authorities as members of Roddey’s 4th Alabama Cavalry Regiment.

Officers probably recruiting for this command captured in Lauderdale County or nearby in the last quarter of 1863 included the following --


  • Major Lamar Fontaine,
  • Major Frank Foster, Jr.,
  • Capt. William R. Chisholm,
  • Capt. A. C. Foster,
  • Capt. Joseph Haslip,
  • Capt. John B. Weakley.

    It appears that survivors of this command reorganized as Co. "M", Roddey's 4th Alabama Cavalry.
