Arkansas Post/paroled soldiers?

I posted a query on the Louisiana board a couple of weeks ago wondering why the Louisiana boys got to come back to Louisiana after being paroled. Alan Pitts posted that Waul's Texas Legion also got to come back home, which I did not know.
Still brings me back to my original question. Why did the majority of the soldiers end up in the AOT and just a handful getting to come back west of the river. One answer was that the soldiers got to choose, but I question this as it would seem that the Texas and Arkansas boys would come home if given the choice. Or is my theory wrong? I know that later in the war the Trans-Mississippi soldiers threatened to desert when word got out that they were going to be sent East of the river.
