The White County Militia was re-organized on 11 March 1861 to consist of three regiments. The two new regiments were:

and Volunteer Company Light Infantry

Jas P. O. Wood 3rd Lieut

65th Militia Regiment Col. Dona Rogers 11 March 1861 White
and a Vol. Co. West Point Rangers

A. J. Jones, 1st Lieut

W Burney 2nd Lieut

George H. Hale 3rd Lieut

But Hathaway must not have stayed with the West Point Rangers because he is listed as a Major in the 65th on 31 January 1862.
