So here is how I understand the situation....

When the Confederate Congress passed its Conscription Act in April of 1862 the intent was that conscripts would only be used to provide replacements for those regiments already in Confederate Service, but General Hindman used the act, some would say illegally, to build new regiments to replace those units which had been transferred east of the Mississippi. Hindman encouraged men to volunteer by directing that units formed before a certain date in June 1862 could still elect their officers, but units formed from conscripts after that date would have their officers appointed. The Confederate Congress then came along and authorized the acceptance of these illegally formed regiments and battalions, and in Order 108 in October 1862 gave these conscripted regiments the right to elect their officers just and volunteer regiments had traditionally been allowed to do. Morgan who had been appointed Colonel of the 26th at it's formation, decided not to stand for re-election. It sounds like the election occurred on April 30, 1862 while the regiment was at Fort Smith, but apparently Yell did not immediately accept by instead offered his resignation a Major, but this was not accepted. Yell was on leave much of the summer of 1863 and therefore Morgan was still in command for the Battle of Devil's Backbone on September 1, 1863. Yell apparently accepted his commission as Colonel of the 26th Arkansas on December 6, 1863, and Morgan was relieved as of that date. Yell remained in command until he was killed at the battle of Pleasant Hill, LA, in the spring of 1864 and he was succeeded by I.L. Brooks.
Does this sound about right? Also do we know what other regiments were reorganized under this order? I would assume that it affected all of the Hindman Regiments?
