Was 35th really ever Rector's Regiment

Taking a look at Rector's records, I am becoming suspicious that Rector every really showed up for service with the 35th/22nd other than on paper. He had actually resigned as the Colonel of the 17th Arkansas on March 20, 1862, well before the unit departed Arkansas enroute to Mississippi. The 22/35th is formed on July 11th, 1862, and the muster roll for that period includes his name as Col, but doesn't state that he is present, and by August 12, 1862, a month later, he is submitting his bond as a Quartermaster for the Brigade in the rank of Major.

I wonder if he was appointed but either could not face the veterans of the 17th who were in this new command or was rejected by them due to his alleged Failure at the Battle of Pea Ridge?
