31st Ga. Flag Captured at Shepherdstown

There is a flag at the Museum of the Confederacy identified as WD 106, 31st Ga., abandoned at Shepherdstown, Sept 1862. While researching the 38th Ga. I found a paragraph written by Capt. William C. Collins, of the 38th Ga., that reads: "The 38th Ga. regiment was put on picket duty at the ford (Shepherdstown Ford) on Sept 19th and was surprised and driven off, losing one man killed and two wounded, and I am sorry to say we lost in this little fight our battle flag that we had carried from Savannah, Ga. Our color bearer was killed and in the confusion of the retreat it was forgotten." Could this flag attributed to the 31st Ga., belong to the 38th Ga. instead? I'm not aware of the evidence that attributes the flag to the 31st Ga. Would love to hear anyone's thoughts, or if you have additional information on this flag. Regards, Dale Nichols
