Custer was a commissioned officer in the Regular Army. He held the Regular Army ranks of 2nd and 1st Lt and Capt during the Civil War. He was mustered in the U. S. Volunteers as a Brig Gen, a Brevet Maj Gen and as a full rank Maj Gen, those commissions being confirmed by the U. S. Senate. He never held an appointment from a state government.
