In late 1863 and early 1864 the cavalry and infantry regiments of the Department of Western Virginia (a separate Department from the ANV) were issued a number of Virginia state flags. At Winchester these units comprised Breckinridge’s Division (commanded by BG Gabriel Wharton) and McCausland’s and Jackson’s Cavalry Brigades.

The Virginia state flag of the 36th Virginia is known to have been captured at Winchester by Sergeant P. H. McEnroe of the 6th New York Cavalry.
