Capture of North Carolina flag February 6, 1865

On The afternoon of February 6, 1865 at hatchers run, Virginia, Sergeant Daniel Caldwel of the 13th Pennsylvania cavalry took part in a charge Along with his regiment against Confederate North Carolina infantry. The regiment captured 66 men and one flag. The flag was captured by Caldwel himself as well as five prisoners. According to union records the flag belong to the 33rd North Carolina infantry.

This cannot possibly be true. The 33rd belongs to james Lane’s North Carolina brigade which was not engaged at hatchers run on February 6.

During the day the cavalry fought against two infantry brigade‘s from gen. John Pegram’s division. One was Lewis’ North Carolina brigade and the other was pegram’s old brigade of Virginians.

I appreciate any help that this group can give me
