The 9th was merged with parts of the 3rd GA Battalion in the Spring of 1863 to form the 37th Georgia Infantry, which was for a short time refered to as the 1st Georgia Infantry, the new regiment was assigned to William Bate's Brigade. The 37th's first engagement was at Hoover's Gap, TN, then at Chickamauga where they lost fifty percent of their total number. They would participate in the main battles and campaigns of the Army of Tennessee.
