Again, the document referenced most likely will be found with the Old Army Records at the National Archives in Washington, D. C.

The 40th Georgia Historian, listed below, may be of some assistance.

E P. Phillips

Residence Floyd County GA;
Enlisted as a Private
"C" Co. GA 40th Infantry
(Buried in Oakland Cemetery, Atlanta, GA.)
Sources used by Historical Data Systems, Inc.:

................

E. P. Phillips, Private, Company C, 40th Georgia Infantry, there exists in his file a Reference Card which states:

"See Manuscript No. 1999, Page 28," with further notations "Died Dated April 25, 1864"

M266: Compiled Service Records of Confederate Soldiers Who Served in Organizations from the State of Georgia

As he was not previously listed, he must have enlisted early in 1864, after the last recorded Company muster-roll which covered the period Nov & Dec, 1863.

The regiment participated in the 1863 Vicksburg campaign and in the battles of Missionary Ridge and Chattanooga before moving south into Georgia where he must have died of disease in an Atlanta area hospital shortly after enlisting.
