christopher hogan

i am searching for information my gr-gr-gr-uncle, christopher hogan's military service in the war between the states. christopher was born in 1840 at hogansville, troup co, ga. he enlisted in the 36th ga. infantry regiment early in the war and mustered out in may, 1962. Family lore has it that he went north, taking his slave with him, enlisted in a union regiment, sent his slave home, and served as a union scout mostly in ky. and later in the new state of west va. until the end of the war, having attained the rank of first sergeant. however, i find also the record of a confederate soldier of the same name, captured in may, 1864 in philadelphia and charged with "committing robery of paymaster malone". can anyone shed any light on this? i would be very grateful for any information about christopher.
