I'm confused. Wasn't Col. Daniel Newman McIntosh colonel of the 1st Creek Regt and his older brother Chilly was colonel of the 2nd Creek Regt?

In Gen S.B. Maxey's report, he says:

I send you a specimen of a series of letters that fell into my possession, written in red ink, all of them by Colonel W. A. Phillips, commanding at Fort Gibson. I have one addressed to the council of the Choctaw Nation, one to Colonel Jumper, chief of Seminoles, one I send you to Colonel Una (D. N.) McIntosh, Second Creek Regiment. One was written to Governor Colbert, of the Chickasaw Nation, whose house they burnt, which I have not yet got.

OFFICIAL RECORDS: Series 1, vol 34, Part 2, Page 995

The "D.N." in parenthesis was apparently original to the report so Maxey is stating that Col. Daniel N. McIntosh is colonel of the 2nd regiment and that D.N. is "Una".
