I would add the following excerpts from the Official Records regarding reorganization efforts within the Indian Division during 1864 under BG D. H. Cooper. Keep in mind that BG-AMG S. B. Maxey newly commanded Indian Territory, all under the command of Lt. Gen-Gen. E. Kirby Smith, Trans-Mississippi commander at Shreveport. Note the following (with my comments) in chronological order:

Pres. Jeff Davis (2-22-1864) (Vol. 34-3-824) (Decisions made at meeting with Indian delegates elected Nov. 1863 Council that were sent to meet with President Davis.) (Published as a Circular at Ft. Towson on 5-14-1864 by MG Maxey): President Davis at Richmond required three full brigades to be raised before the Indian Division can have a Major General (to command an Indian District). Davis adds that each Indian brigade must have at least three full regiments (based on CSA standards). Current Indian Division organization under Brig. Gen. D. H. Cooper will remain until sufficient full regiments have been raised, as current number of troops are insufficient.

D. H. Cooper (10-6-1864, at Camp Jumper near Perryville) (Vol. 41-3-982) … The Choctaw brigade, excepting the Chickasaw Regiment and McCurtains battalion, is here. The Chickasaw regiment allowed to remain at Cochran’s for reorganization. …

D. H. Cooper (10-10-1864) (Vol. 41-1-36) ”… and the force under my command is much weakened by the expiration of the terms of enlistment on the part of the Choctaw Brigade … and to give time for reorganization and recruiting the Indian brigades.”

S.S. Scott, (CSA’s Indian Commissioner on annual visit, Aug.- Oct. 1864, from Richmond to Indians) (12-1-1864) (Vol. 41-4-1086) Writes: Indians (under Cooper) are attempting to organize as:

Cherokee Brigade, Choctaw Brigade, Creek Brigade

(not stated but perhaps regiments as follows:)

. Cherokee 1 . Choctaw 1 . Creek 1
. Cherokee 2 . Choctaw 2 . Creek 2
. Osage . Chickasaw . Seminole

E. K. Smith's Trans-Miss Dept. Command Report (12-31-1864) (Vol. 41-4-1145): Shows only two Indian Cavalry Brigades (under Watie and Walker), with only 1,235 Indian troops present-for-duty out of 6,618 total enlisted. BG Cooper could just never get the counted numbers up (those counted at Shreveport) to the high levels President Davis had required.
