Doug, the KY volunteers gathered at Camp Boone and, to the best of my knowledge, Withers (who'd been active in their recruitment) was acknowledged as commander of the camp. Since the troops there numbered several regiments, it was considered a brigade commad and Wither took the temporary title of acting general. He wasn't commissioned as such by either Pres. Davis, or the Governor of KY. It appears to have been an informal choice of the officers at Camp Boone.
