Your second paragraph points to the fact that, while Provisonal Enrolled Missouri Militia men were pensionable while few saw much service and then not for their designated purpose, the Provisional Enrolled Militia in spite of more direct contact with the enemy, were not pensionable. The decision was based upon the theory that the latter operated in company formation, not regimental, as did the former. The frequency of pension applications for both the Enrolled Missouri Militia soldier and the Provisional Enrolled Militia soldier underscores their (and their attorney)misunderstanding of the pension law. I would venture to say that many of the latter two classes of soldier saw more action in Missouri and Arkansas than scores of Provisional Enrolled Missouri Militiamen.
