David Fultz, killed by Jennison?

I'm seeking information about the death of David Fultz, 2nd Kansas Militia - he was killed 23 October, 1864 in the aftermath of the battle of Westport. From what I have gathered, he escaped serious injury in the Battle of the Blue on 22 October and either was captured and escaped or was seperated from his unit and discovered by some of Col. Jennison's men the next day as they were pursuing the Army of General Price southward. There are differing accounts as to what happened next. One report says he was mistaken for a Confederate Guerilla and shot and left by the roadside to die by Jennisons men and another account has him joining the command of Col. Moonlight and mistaking this unit for Rebels, and giving information to the effect that he was glad to be joining the Confederate side. He was then executed for this insurrection.
