Bud Shirley was killed by....????

I'm trying to figure out just who killed Belle Starr's brother, Bud Shirley at Sarcoxie, MO.

A few things I have come across says that he was killed by members of the 15th MO. Cav., Co. C., formerly the 7th Prov. Enr. MO. Militia.

But....

Then I see this on Bud Shirley's FindAGrave page. It's from the Carthage Evening Press, Carthage, MO., Thur. February 5th, 1903:

"Word was given to federal soldiers in camp at Cave Springs, six miles east of Sarcoxie, that the notorious bushwhacker Bud Shirley was in Sarcoxie.
A squad under command of Lieut. Brice Henry, went out and under cover of darkness surrounded the house he was in, which stood at a northwest corner of the square near the lumber yard. A signal was given by one of the boys calling out "here they are boys" and firing at the same time. Shirley ran the other way running into a squad of soldiers when he fell, being instantly killed and riding the country of one of the most desperate outlaws Southwest Missouri ever produced."

Capt. Stotts Co. G, 76th E.M.M. was the regiment at Cave Springs and Brice Henry was a Lt. in Co. G.

So was he killed by the 15th, Co. C or Brice Henry and others from 76th EMM, Co G.?
