What I find interesting is the reference by the JAG that the 9th Kansas Volunteers were illegal in 1861/62 thus "don't exisit". That appears to have been taken to heart by the US Army as there is no official record of the unit until 1864 when it was "called up" for Prices raid, even on the KS National Guard history site. I also don't find where the Cass Co Home Guards were ever federalized yet members got pensions and headstones post war. I suspect they were an embarrassment to the Union Army leaders but their ruthlessness and aggressiveness suited their purpose with "plausible deniability"

This case being a claim for supplies or stores alleged to have been taken by or furnisbed to the military forces of the United States for their use during the late war for the suppression of the rebellion, the court, on a preliminary inquiry, finds that Irvin Walley, the person alleged to have furnished such supplies or stores, or from whom the same are alleged to have been taken, was loyal to the Government of the United States throughout said war.

deceased, v. The United States.)
STATEMENT OF CASE.
The claim in the above-entitled case, for uso and occupation of real estate by the military forces of the Uuited States during the late war for the suppression of the rebellion was transmitted to the court by the Committee on War Claims of the House of Representatives on the 15th day of July, 1892.
On a preliminary inquiry the court, on the 20th day of November, 1893, found that the person alleged to have been the owner of the property was loyal to the Government of the United States throughout said war.
The case has been brought to a hearing on its merits.
Charles and William B. King, esqs., appeared for claimant, and the Attornoy. General, by John G. Capers, esq., his assistant, and under his direction, appeared for the defense and protection of the interests of the United States.
The claimant in her petition makes the following allegations:
That the following property belonging to the deceased claimant, Irwin Walley, was taken from him by the United States Army, in the county of West Point, State of Missouri, for the use of said Ariny, to wit:
On or about September 15, 1861, United States troops under command of General Lano and other officers took possession of, used, and occupied for the said Army a double two-story brown-stone building, and lot, and continued to occupy the same until March 1, 1864, twenty-nine and one-half months, at $50 per month, making a total of $1,475.
The court, upon the evidence and after considering the briefs and arguments of counsel on both sides, makes the following:
FINDING OF FACT.
The reasonable rental value of the property of claimant's decedent during the time it was occupied by the military forces of the United States was the sum of four hundred and eighty dollars ($480), which does not appear to have been paid.

Walley clearly profited from the war in terms of cash and real estate, going from $1000 net worth in 1860 to $25,000 just 10 years later!

His daughter in her Social Security Admin application lists him as Capt. I Walley so I presume his service and rank were a source of pride for his daughter/children.
