I don't think that there was a prohibition against pensions for persons who only served in the State organizations. I think that, if you could prove military service, whether in a State or Confederate unit, you could get a pension. If there were any prohibition at all, I would think it would have been against those organizations that only served for short periods, like the 30-day and 60-day troops.
