VA headstone ?

After years of searching, I finally discovered the burial site of one of my Confederate cousins. I found that he is buried in the Confederate Soldiers Rest section of the Elmwood Cemetery in Memphis TN. His name is Edward Stuart and he had served in the 18th Mississippi Infantry and was also assigned to the signal corps in W.F. Lee's Cavalry Reg.
His grave is marked with a small marble stone that has only his name inscribed, however the name is misspelled (E. Stewart instead of Stuart). I thought that I would be able to get a VA veteran's headstone for Edward, but upon reading the VA's application form it appears this may not be possible, since it states that only "unmarked" graves are eligible for the VA headstones. I was wondering, that since his name is misspelled on the marker, if I would be able to get a VA headstone. What do ya'll think?
