Prior Service re Conscription

Question: If a 38 year old completes his one year of service and discharged as over the age of conscription. Would he have been subject
to later service when the age of conscription was raised to over his present age? I realize in this case that the age was increased to 45 on
September 27, 1862, just prior to his discharge. See example:

John B. Baker, age 38, resident of Wake County, N. C., enlisted as a Private in Company C, 31st North Carolina Infantry (State Troops) October 4, 1861 in Wake County by A.lW. Betts for one year, captured on Roanoke Island, February 8, 1862, released on parole at Elizabeth City, N. C., February 21, 1862, discharged October 4, 1862
