Captured North Carolina flag question

On The afternoon of February 6, 1865 at hatchers run the 13th Pennsylvania Cavalry made a charge against North Carolina infantry and reportedly captured 66 men and one battle flag

According to union records Sergeant Daniel Caldwel was credited with capturing five men and the flag of the 33rd North Carolina infantry.

The Union records are mistaken because the flag did not belong to the 33rd North Carolina. This regiment was part of James Lane’s North Carolina infantry brigade, which was not engaged at hatchers run.

On the afternoon of February 6 the second brigade of Union cavalry fought against two confederate infantry brigade, one under Lewis, was from North Carolina. The other was a Virginia brigade.
