Interesting.

So technically, since Davis won his appeal before the courts, that the 14th Amendment applied to his situation in prison, the 14th Amendment repealed all previous laws orders and directives which denied Lee, Davis and all other ex-Confederate Officals of their constitutional rights of citizenship. Such as to vote for example.

I wonder why no one ever tested this? It wasn't until the late 1880's before some of the old Confederate generals began to run for political office again.

I would have thought that Jefferson Davis, for example, could have easily won reelection as a Senator from Mississippi by the mid 1870's as soon as the carpetbag governments in the south were thrown out. I would suspect that politics would have been more to Davis' liking than the land speculation and farming that he did do after he was freed from prison.

Lee repeatedly petitioned through governmental channels for the restoration of his citizenship rights until his death in 1870. To no avail. After passage of the 14th Amendment, why did he need to continue his petitions?

We think of the 14th Amendments appling to the ex-slaves, but we never think of the same amendment appling to the ex-Confederates officials themselves.

SOooooo Gerald Ford was demonstrating his lack of knowledge of history and legalism and restored to General Lee what in effect Lee already had since July 9th, 1868.

Curiously California, a Union state during the War, didn't ratify the 14th Amendment until 1959. Yes 1959 is correct. Maryland rejected it in 1867 and didn't ratify it either until 1959.

Delaware another Union State rejected this amendment in 1867 and did not ratify it until 1901. And Kentucky after rejecting it in 1867 did not ratify it until 1976.
