However, Lincoln as President of the United States did NOT have the authority as President to superceed the Constitution.

Therefore, Lincoln could not legally, without a Constitutional Amendment repealing Article 4, Sec 2, Para 2, of the Constitution, which did not happen until 1865, free any slave, for any reason, in any state under United States control, unless that state was a part of a foreign national power. A legal point which Lincoln expressly denied that the southern states were.

And he certainly could not free any in the northern state "legally", even under the confiscations acts because of the 5th Amendment. And that is why the Emancipation Proclaimation did NOT free any of the slaves in the Northern States including even those owned by U.S. Grant.

Making up your own laws without legal authority is called a dictatorship and tyranny. That is not being subjective.
