I'm kind of hazy on this, but I think under the Judicary Act of 1789, Jefferson Davis would have had to been tried in Virginia with Virginians on the court. They would have needed only one vote to acquit. Now let me see with twelve Virgins on a jury could they find one that would set Davis free?....yeap I think they could. This happen in some rebellion in Pennsylvania but the court shifted around someway and took this Dutch-American out of the area...sorry but don't remember now what happen, will get back to you.
