Lincoln's own cabinet shared your view, George. When he submitted his draft proclamation to his cabinet on July 22, 1862, the authority of the government to free the slaves was debated, until Lincoln put a stop to the discussion by declaring his belief that his war powers was the only authority required. The discussion then moved on to whether it was expedient to issue the proclamation, when it could not be enforced. That's one of the reasons why Lincoln waited for a significant Union victory before issuing the proclamation -- it gave the appearance, at least, of acting from a position of strength.

Ever since, legal scholars have questioned the authority for issuing the Emancipation Proclamation. The question became moot, of course, with the adoption of the 13th Amendment to the Constitution, but the question of the presumed (or assumed) powers of a war-time president is as relevant today as it was in 1862, e.g., Roosevelt in World War II, Johnson in Vietnam, Bush in Iraq.
