It's good to see one of your excellent posts again.

The Governor of South Carolina was within his rights to demand that captured U.S. colored soldiers be remanded to State custody. According to Paragraph 514 of the Military and Naval Laws of the Confederate States, "All negroes and mulattoes who shall be engaged in war, or be taken in arms against the Confederate States, or shall give aid or comfort to the enemies of the Confederate States, shall, when captured in the Confederate States, be delivered to the authorities of the state or states in which they shall be captured, to be dealt with according to the present or future laws of such state or states."

The law made no distinction between slaves or free blacks, Southern or Northern born.

However, the court opted on the side of expedience in the case of the 54th USCT prisoners, recognizing correctly, I believe, that the U.S. government would likely retaliate against Confederate prisoners. Certainly, the U.S. government had previously demonstrated its willingness to retaliate for real or imagined wrongs.
