Are you saying that under the COnfederate Constitution, that even tho they instituted a draft and were able to call men up from the various states, that President Davis was not allowed under law to call on the various state Militia's for service under the national government? It would seem to me that if they could draft men, they could call state troops up also. Did he not have any "war time" powers like Mr. Lincoln did? It seems to me from what I have read in the past, that as the hostilities progressed it got harder and harder to keep men in the army. I would have to dig it up, but I remember Davis making that very complaint in a letter to someone, I forget at the moment.
