Legislative law is malleable and determined by bias and whim. It can be changed, and sometimes is, at every election. Constitutional law is designed to be unbiased and very hard to modify. Are you implying that the whole Constitution is legislative law? If so, then why did they determine to include the clause "Congress shall have power to enforce this article by appropriate legislation" into almost every amendment after Lincoln? Shouldn't the amendments words be straight forward enough, as law, not to remind Congress they had the power to use the amendment as a basis to write legislation?
