I would believe that they would have been looked upon in the same manner as children who were born in lands than eventually became Territories of the United States. That because the southern States had to be "reconstructed" that this question and their status of citizenship would have been covered in this manner when the southern states were "readmitted" to the United States when they met the requirement for readmission, and the ex-citizens of the Confederacy were given their rights back as Citizens of the United States.

If you will remember that were a large number of southerners who never signed any oaths and never surrendered with any Army. There were many southerners who absolutely refused to take that Oath. Remember the lyrics to "I'm a Good Old Rebel" They simply went home or have been discharged from the Confederate army prior to any surrender and were not carried on any muster of that army when it was surrendered. Those people had also renounced their citizenship in the United States hadn't they. This readmission would have covered all those citizens who had not been covered by the 13th 14th and 15th Amendments or by taking "the Oath".

While I do not know of any "lega;" actions on this matter. It would seem that had there been, this would have been the basis for any such legal argument.
