My understanding is the Constitution very clearly mandated the federal government was to "fill the vacuum". I think that Lincoln's War effectively reversed the process forever. The U.S. Congress and our Presidents have habitually ignored the 9th and 10th Amendments since 1860. There is no "state soveriegnty" as our ancestors knew it.
