Nope. That article did not apply then and would not now cover a state declaring its self independent from the U. S. Constitution and the union. That law only covers states that are a willing state of the union within the Constitution. I.E. That article did not apply to North Carolina, Rhode Island or even Vermont, when the U.S. Constitution went into effect on March 4, 1789, because they did not join the compact. They were considered foriegn states or republics. No where in the Constitution does it say state ratifications of the compact (U.S. Constitution) was perpetual.
