The slaves "confiscated"during the war were treated as contraband and were not covered by the 4th amendment, at least in the eyes of the North who were making all the rules. I don't believe the issue of confisation was ever tested in court. But that wouldnt matter anyway since the 13th Amendment was not a congress made law, but an amendment. So, it's ratification would render any issue of compensation moot, in practice if not in theory. So if you owned a slave and that slave was seized by the US government as contraband and year later the 13 th was ratified, your cause of action is gone. And, as I said earlier, in practice if not in theory.

Which brings to the pointI was making, vis, Lincoln knew the 13th Amendment was likely to be ratified, so why bother with compensation. Comensation was rendered a dead issue upon ratification.
