"He applied for a pardon from President Andrew Johnson, endorsed by his old friend Ulysses S. Grant. Johnson refused, however, telling Longstreet in a meeting: "There are three persons of the South who can never receive amnesty: Mr. Davis, General Lee, and yourself. You have given the Union cause too much trouble." The United States Congress restored his rights of citizenship in June 1868."

The 14th Amendment of 1868 Section 3...

"Section 3. No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may, by a vote of two-thirds of each House, remove such disability."

That seems to be the catch. Lee's application was never voted on until 1975. So, while the law that paved the way for his citizenship to be restored was enacted in 1868 his actual application was not approved by the needed 2/3 vote of Congress until 1975.

If I remember correctly President Jimmie Carter signed Jefferson Davis's application. While I don't recall the details I do recall some years ago emailing the Carter Library asking about this and they conffirmed it as fact to me. Seems though lately I have been rubbing folks the wrong way so I don't want to go any further on Carter/Davis. If I get chastised for bringing up the fictional character of Sherrif Andy Taylor can you imagine how folks would feel if I somehow brought up the old TV show "Carter Country"? LOL...
