Section 9 of the Constitution states: The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it. The problem was that we were not rebelling against the government, we were merely trying to secede. Mr. Lincoln chose to consider that action a rebellion. The writ was suspended against US citizens, and had no effect on the CSA.
