I don’t have enough data to say one way or the other. The flags of the Trans-Mississippi had a motley number of flags, varied in appearance, on a company level it is a possibility. Since other State Troops are know to carry black flags of deferent designs, it would seem the Texas Troops did also but I have not uncovered evidence to verify C.A. Dana’s report. In the prior War, the Mexican Troops carried skull & crossed bone flags, several survive.

The phrase “Fighting under a Black Flag” does not necessary mean that an actual black flag was used, it was intended to convey no quarter would be given.

The privateers of this period are not know to carry a no quarter flag as the privateers of the 16 & 17 hundreds but it is posable some did. Reported in the Harpers Weekly a black flag with scull and crossed bones was used on a dummy ship that was design by the Union to draw fire from Vicksburg in hopes that they would run low on animations.
