He was discharged on 11/1/1862
(Discharged for being overage)
He was described at enlistment as:

For 44 years Tony Welters was a slave of the Fontane family, serving for much of that time as a “special servant and body guard” to the family patriarch John M. Fontane who directed that Welters be manumitted upon his death..

After Fontane emancipated his trusty servant Tony Welters, Welter’s married Cydra Benet at a Catholic ceremony in 1958

Shortly after the 1860 census, Welters must have obtained his freedom, for he enlisted in the town militia, the St. Augustine Blues

June 24, 1861 Tony Fontane, a recently freed black joined the local militia, the St. Augustine Blues as a Fifer. p. 93

This militia was formed as the American Civil War loomed

Post war, Tony Fontane, changed his surname to Welters (Antonio Huertas) Presumably in honor of his father.

The Saint Augustine Blues were a militia unit formed on May 12, 1860 in St. Augustine, Florida during the period of political instability in the United States preceding the outbreak of the American Civil War. The Blues officially entered the Confederate Army at Ft. Marion on August 5, 1861 and were designated Company B of the recently organized Third Florida Infantry.
