He was not an officer of the Legion. I will ahve to check the roster of the 24th VA; and I do not have a readily available roster of the 7th Cavalry. Could he have been one of the Richmond City Battalion, which periodically reinforced the lines south and east of Richmond? Just a guess. Some units of Henry Heth's division were also north of the James at this time.
