The Hampton Legion, which was then still an infantry regiment, was assigned to Jenkins' South Carolina Brigade, and was detached from Pickett's Division following the Suffolk Campaign and left to guard the line of the Blackwater in May, 1863. Despite Lee's efforts, it was not allowed to return to the ANV, but remained in the neighborhood of Petersburg in June and July, 1863, guarding the approaches to Richmond nd Petersburg during the Gettysburg Campaign. Its only action was a minor skirmish at Baltimore Cross Roads east of Richmond on 4 July. In early September, it was reassigned to Hood's Division, and went west with Longstreet, but the brigade was the last infantry unit to entrain, and did not arrive at Chickamauga until the night of September 21, missing the fighting there.

It was ordered back to S.C. to obtain mounts in March, 1864, and then reclassified as mounted infantry.
