I did answer your letter over on the Flags Message board. I was just checking the S.C. board today and saw your questions and replies.
When the flag was removed from our Capitol dome in 2000, a rider was inserted into the Act that protects historic monuments by State Law. A friend of mine has made it a point from that time to place flags, many of them, at roadside markers on the Jefferson Davis Highway and at any other monuments available where he can honor the memory of the Confederate soldier. He was challenged soon after he began by the DOT. After his rebuttal, and assistance from the Attorney General, there have been no protests. Vandals at time have torn down flags and in some cases the poles. His response: install a bigger pole and a bigger flag. He is quite tenacious and the flags are wondrous to behold as you drive along Highway 1. By law, his flags cannot be removed (the age of the monument notwithstanding).
There would indeed seem to be a question of title here since the UDC property is on Church grounds. I do believe however that the Law would stand with the monument.
