The only problem is he was killed in Nov. 1862, before that reorganization took place, and he was a Captain, not a Lt. My best bet is he initially enlisted or planned to enlist in the 13th (known in the field as the 8th), but got a better offer as a Captain in the 4th. The 13th did recruit in the same area as the 8th and might have been in competition for officers.
