Let me ask for a little explanation. For 'discharge', do you mean when a soldier left service during the course of the war, or the language used in the Appomattox parole, or something else? If it's the first two, discharges and paroles received by officers and men of these two regiments were identical to other discharges and paroles issued at the same time and place.

As for enlistment oath, I only know about the enlistment part. The 17th Tennessee organized under regulations of the Provisional Army of Tennessee. The 23rd Tennessee organized after the P.A. went out of existence, but both regiments entered state service first. After the Governor of Tennessee offered their services to the Confederate Government, these men mustered in Confederate service.

Which enlistment do you have in mind?
