Greg, I notice that a Michael Burke was Lt. in O'Neill's old Company A, 10th TN. This Burke was CM'd in 1863 for being AWOL, and has no further CSR record. Would it be too much of a stretch to presume that O'Neill brought in his old buddy and wangled a de facto 2nd in commandship for him?
