The rule for a VA Confederate marker is that they will not provide a marker if the grave has a proper marker in place. If it is marked with a rock-stone or wooden post etc. or nothing at all then you could order a VA marker to install as a proper marker. Also, if the old marker is broken it can be replaced with a VA marker.
