Deserters

I have an ancestor, Capt (more likely private) Hardin Davis, from Pittsylvania County, VA who served while in his 50's as a guard at Danville Prison. He had three sons (William George Davis, John Edward Davis, and Micajah Dark Davis), who served as privates with Company K, 38th Va Infantry. It appears that each of them deserted several times and then later returned to their unit. In May 1864 they deserted together while at Drewry's Bluff near Richmond. Were deserters punished?
