At 4 am on the morning of 3 July 1863, the 4th Virginia was posted along the captured breastworks on the southern slope of Culp's Hill, where it was subject to Federal artillery fire. About 0530 it was pulled out of line and charged against the Federal works to the west. Men were shot down as the regiment advanced. Many of the men got up so close to the Union lines under a ledge that they could not advance or retreat, and when the fighting subsided after 11 am, a large number of them surrendered, and I believe their colors were taken at that time as well. Four companies of the 122nd New York were in the trenches in front of them at the time.
