PORT HUDSON, LA., January 13th, 1863.

To John R. Fellows, A.D.C. & A.A.A. Gen’l Army of Miss. & East La.

The petition of John Carroll, Ord. Serg’t of the 1st Batt’n Arks Vol., most respectfully herewith, that upon the promotion & assignment to duty of Capt. W. G. Rolfe, former Ord. Serg’t of said Batt’n, on the 26th day of Dec’r 1862, your petitioner was on the 28th day of said month appointed Ord. Serg’t, as will now fully appear by reference to his order of appointment herewith exhibited. Said appointment was made while Major M. R. Wilson was under arrest, and the Battalion, 15th & 16th Arks Reg’ts consolidated before said Major M. R. Wilson was released from under arrest. And by order of Col. Johnson of said Consolidated Reg’t, your petitioner delivered to W. C. Porter, Ord. Serg’t of the 16th, such ordnance stores as were in his possession and was told by the said Col. Johnson to remain as he was until the Ordnance Sergeants not actually required in consequence of the consolidation of the several Reg’ts, would be disposed of by order of Gen’l Bealle, which your petitioner has accordingly done. But the said Johnson has on this day ordered your petitioner back to his former Company to report for duty, and your petitioner being convinced that said order has been made through the instrumentality of the aforesaid Major M. R. Wilson, who is greatly prejudiced against him, most respectfully prays to have his case submitted to Gen’l Bealle and to have him disposed of as other extra Ord. Serg’ts or assigned to some other duty where he will not be subject to the prejudices and persecutions of the said Major M. R. Wilson. And he as in duty bound will ever pray.

To Capt. Bealle Hempstead, A.A. Gen’l, 4th Brigade, Army of Miss. & East La.

SIR—Your petitioner, John Carroll, Ordnance Serg’t of the 1st Arks Batt’n of Infantry Vols, most respectfully begs leave to present this, with the two accompanying petitions, endorsed by Maj. Gen’l Gardner, which though they do appear to be contradictory of each other, as his petition to be submitted to the proper authorities for consideration, and most respectfully states in addition thereto that he has on this day received another order from Col. Johnson to report to his Company for duty. The said Col. Johnson says that he has made said order at the request of Maj. M. R. Wilson, and based on the endorsement of Gen’l Gardner on the petition or communication of the said Major Wilson, which is herewith exhibited, and one of the petitions above. Those petitions speak for themselves. And as Major Wilson is still a Supernumerary, and that Lt. Col. Batt Jones, who is still under arrest, ranks the said Major Wilson, your petitioner desires to know whether the said Major Wilson has a right to have the appointment of your petitioner revoked, how much soever he may be prejudiced against him. Your petitioner further states that his appointment has been sent to the Secretary of War, with recommendations and a full explanation of the circumstances of his appointment, for his approval and confirmation, which your petitioner has reason to believe is favorably acted upon before now. RICHMOND, VA., February 7th, 1865.

Honorable Secretary of War.

The undersigned, a private of the 1st Battalion of Arkansas Infantry in the year 1862, was appointed by the Commander of said Battalion, ordnance sergeant of said Battalion on the 28th December 1862, and the application for the warrant was properly endorsed and sent to the War Department from Port Hudson, Louisiana, and is now on file in the office of Adjutant and Inspector Gen’l, Richmond, Va. This appointment was not confirmed at the time for the reason that the roll of the Battalion was not then in the said office. In the meantime the undersigned has been on duty as ordnance sergant aforesaid, and ordered to duty in the Trans-Miss. Department.

The roll of said Battalion being now on file in the Adjutant & Inspector Gen’ls office, it is now respectfully requested that the appointment be confirmed and the proper warrant issued in this case.
